Entrapment using obscured traffic light

My father had to pay the traffic cop when we were stopped after supposedly making a turn after the light had turned red. We had no idea the light had turned red since it was on a pole behind a tree branch; but the choice was to pay him or he confiscates the license and we would have to go collect it at the Traffic Office and pay someone there.

I don't understand why it couldn't be a ticket instead of confiscating the license.
